Wings Of Prey: Wings Of Luftwaffe Announced; Prey On Sale

Gaijin Entertainment's announced Wings Of Luftwaffe, an addon for their well-received combat flight sim, Wings Of Prey:

The German attack begins! Gaijin Entertainment today announced the development of Wings of Luftwaffe, the first major add-on for the highly popular World War II air combat sim for the PC, Wings of Prey. Air combat fans can get 30 percent off the price of the expansion, which Gaijin will release in April, by preordering the product on yuPlay.com.

The expansion will feature ten single missions with support for up to four players in co-op mode, two new planes and over 40 skins for the various planes.

In Wings of Luftwaffe, the player takes the role of a German pilot and participates in explosive battles over Britain, Sicily, the USSR, Belgium and Germany. From blocking airdromes, to attacking aircraft, to destroying ground targets, the player will fight with honor and bravery for the glory of Germany.

"Players will enjoy strapping into one of the game's many planes and seeing the Second World War through the eyes of a German pilot," Kirill Yudintsev, project manager at Gaijin, says. "We put our players in the heat of battle, and have created an experience so lifelike, you'll feel your padded seat yield to your weight as you evade the attacks of your enemies. Wings of Luftwaffe is your chance to experience first hand the desperate fight in the skies over Europe during World War II."

    Cheyenne Mountain Entertainment All But Dead; Stargate Resistance Sold On

    A lengthy statement on Cheyenne Mountain Entertainment's website reveals that the receiver has indeed been called in, effectively putting the firm out of its misery. However, Stargate Resistance will live on, having been sold to a new company created by Cheyenne shareholders, as evidenced by continued post-release support.

    In an effort to communicate to shareholders of CME and CMG, this letter is being posted on the company website and emailed to all shareholders for whom we can find email addresses. While in all likelihood it is not a complete list, it is the best information available for shareholders at the moment. Should you personally know other shareholders, please share this information with them. Below, in a question and answer format, is some information that will hopefully clear up some of the apparent confusion that exists with regard to the operations and affairs of CME and CMG. Who is in control of CME and CMG's operations and affairs at this time? The Maricopa County Superior Court (Judge Myers) has ordered on March 15th, that Edward “Ted” Burr of Sierra Consulting Group (“Sierra”) be appointed as receiver to take over the assets, affairs, management, operation and control of Cheyenne Mountain Entertainment, Inc. (“CME”) and its subsidiary Cheyenne Mountain Games, Inc. (“CMG”). The term “Receiver” shall include assistants to Mr. Burr employed at Sierra. Dale Belt, a Managing Director at Sierra, has begun the process of complying with the court order. A copy of the Receivership Order can be found in the “News” section of the CME company website at www.cheyenneme.com. Additionally, on Thursday afternoon of March 18th, Judge Sarah Curley of the United States Bankruptcy Court — District of Arizona ruled that the Receiver shall be recognized as the controlling managerial representative for CME in its Chapter 11 proceeding that was filed on February 12th.

    What is a Receiver?

    A Receiver is a court appointed person responsible for custodial control over the property of others which can include tangible and intangible assets and rights. In this particular instance, the Receiver, who is an officer of the court, has been appointed (as quoted from the court order) “as “receiver to take over the assets, affairs, management, operation and control of CMG and CME?.”. The Receiver is an objective party and does not represent any one party or another and does not report to a board or any other officer or shareholder associated with CME or CMG. The Receiver is responsible to the Judge who appointed him and must comply with the order that was issued.

    How does the Receiver get paid?

    The Receiver is paid from corporate assets and funds available. The court order states that the Receiver shall draw and hold a $10,000 reserve and shall be paid monthly either by the company or the plaintiffs who brought the legal action (see below for more on shareholder lawsuits).

    Why did I receive an email from someone named Dale Grabois claiming he was President/CEO and that he would conduct regular reporting to shareholders?

    As part of the state court action legal dispute, there have been conflicting issues as to who is in control of both CME and CMG. Mr. Grabois is claiming that he was appointed by Gary Whiting as President of CME. While that may or may not be valid, this is not an issue for the Receiver to decide and will be dealt with by the litigants in court. In any event, it is a moot point at this particular point in time because the Receiver has been placed in control of CME and CMG's affairs. If ANYONE claims to speak for or on the company's behalf without the Receiver's authorization, they are in violation of the receivership order and it will be construed as interference. The Receiver met personally with Mr. Grabois on Tuesday March 23rd to convey and confirm with him his understanding on this point.

    What is the current status of CME and CMG's operations?

    As referenced in the second paragraph above, CME commenced a Chapter 11 bankruptcy filing in February. The Receiver is currently evaluating the logic and rationale of remaining in bankruptcy court. If it is deemed to be not in the best interest of CME, a motion requesting that the bankruptcy petition be withdrawn would be filed. CMG and its subsidiaries on the other hand are not in bankruptcy. Currently, neither CME nor CMG have any employees. However, the Receiver has been able to meet with various former officers, shareholders and employees who agreed to meet and provide some limited assistance with understanding where assets are located, what liabilities and unpaid bills exist, where records are located, etc. For the record, the Receiver appreciates their help and assistance especially since they were not compensated for meeting with me. Their goodwill gestures have been appreciated. Based on those discussions, the Receiver believes the following financial issues may exist pending further verification:

  • Cash funds on deposit in known bank accounts controlled by the company are less than $10,000.
  • Unpaid past due general creditor obligations of approximately $2.0 million may exist. There could be more.
  • CME or CMG is named in 5 complaints with estimated potential liability of approximately $10.1 million which includes a disputed landlord claim on space that was never occupied or utilized.
  • Payroll wages of over $1.1 million dating back to March of 2009 remain unpaid.
  • Federal and State payroll tax obligations of $3.0 million have not been paid.
  • An Arizona state tax credit for 2009 that may net $3 million in funds to CMG has been applied for which could be used to cover some or all of the unpaid payroll tax obligations. It has been represented by the CPA firm handling this matter that it could take up to 60 days to realize that credit.

    With regard to actual operations, game development has ceased. Not to be redundant, but there are no employees. The online game, Stargate Resistance, was launched sometime in mid?February prior to appointment of the Receiver. However, because of the funding issue, unpaid wages and creditor issues, a joint venture agreement was entered into on March 2nd with an entity called Fresh Start Studios, LLC (“FSS”) whereby CMG contributed the assets of Stargate Resistance and FSS took over support and all operating cost. The principals behind FSS are some of your fellow concerned shareholders of CME and CMG. They have taken this step in an effort to preserve the game and prevent it from going offline because they felt there was no other alternative. Another logistical operational issue exists with regard to the building premises currently occupied by CME and CMG. Again, due to a lack of available funds, the company cannot pay back due rent and property taxes of approximately $35,000 that is due and the landlord has indicated that he will “lock the doors” at midnight March 31st. In addition, it appears that the actual tenant who signed the original lease is not CME or CMG. Therefore, CME and CMG will begin vacating the premises today unless some unforeseen last minute reprieve occurs. It is a very fluid situation to say the least.

    What are the major deal points of the JV Agreement with Fresh Start Studios?

    In general terms, CMG contributed the software, computers, furniture and fixtures and other assets associated with the operations and development of Stargate Resistance to FSS. In turn, FSS agreed to pay $100,000 to CMG and to fund $200,000 directly to FSS as start up funds to cover operating overhead which would include payroll, rent (in a new space), communications and technology costs, etc. In addition there is an escalating royalty payment due to CMG (through its majority owned publishing subsidiary FireSky Entertainment, LLC) depending on net receipts from sale of the game. FSS is also responsible for payment of MGM's licensing royalty from sales of the game. An important provision in the JV Agreement is a “right of repurchase” granted to CMG. The right allows CMG to repurchase the assets for the $300,000 contribution made by FSS plus 10% during the first 12 months of the agreement. The $300,000 base would increase for any additional capital input into FSS as required to meet overhead expenses. The Receiver has had the opportunity to speak, just by circumstance, with a few shareholders that came to the corporate offices. In these face?to?face meetings, concern was expressed about the FSS transaction and the perception that corporate assets had or were in the process of being stolen as a result. Clearly, based on the deal points outlined above, assets have not been stolen due to the transaction. The principals and certain managers backing FSS are current shareholders of CMG and CME. As represented to the Receiver, their sole intent was to preserve the game and prevent it from going offline due to lack of funding, employees leaving because they had not been paid, etc. The principals did not want to put additional money into CME or CMG because of the current shareholder litigation proceeding in Superior Court and the financial circumstances that exist. As its stands at this moment, the Receiver is faced with a decision point; either ratify the FSS transaction by putting a motion before Judge Myers seeking his approval. Or alternatively, shareholders need to put up additional funds in an amount to be determined that would be used to repay the FSS principals and cover future operating expenses. Undoing the JV Agreement would be subject to negotiations with the FSS principals although it is the Receiver's belief this could be accomplished. If the alternative approach is undertaken, the borrowing of funds must be accomplished literally within days.

    What is the status of the various shareholder lawsuits and related litigation over corporate control?

    The Receiver is not the appropriate party to make any judgments or provide any commentary about the shareholder lawsuits that exist. The Receiver is an officer of the court whose sole duty is to comply with the order and the duties it imposes. The litigants in the various lawsuits involving shareholders and/or officers will have the Superior Court as a forum to deal with those issues. Because of the issues being raised about corporate control and/or alleged wrongdoing, the Judge has decided to appoint a Receiver while that matter proceeds through the court process.

    Issues related to stock ownership in CME and CMG?

    It is apparent from various discussions, emails and comments that there are a number of legal issues with regard to who is actually holding valid stock certificates or perhaps none at all even though money was provided. Because there are no employees, no cash resources on hand and therefore no funds to hire the legal counsel necessary to sort through and investigate these issues, at this time the Receiver is not in a position to investigate the various allegations being made about purchases of stock. If you believe that you may have legal recourse of any kind on this issue, you should seek the advice of counsel.

    Is there any possibility of obtaining additional funding?

    The receivership order specifically allows the Receiver to “incur indebtedness” for the benefit of CME and CMG. It does not allow the Receiver to engage in the sale of securities. Clearly, under the current circumstances, traditional borrowing from a bank or other secured type lenders is not an option.

    Summary

    The Receiver is making every attempt to communicate to all known shareholders. Some existing shareholders are assisting with compiling an email list and this communication will be going out to everyone for which we have email addresses. If someone is left off the email list it is entirely unintentional. The company website www.cheyenneme.com appears to be the most effective way of communicating to all parties. Please check it periodically for future updates. The Receiver is making every effort to provide some stability and deal with the multitude of issues that exist. There are some shareholders that have indicated they may convene a conference call in an attempt to possibly form a committee that could provide a forum for better communications. That action would be welcomed and the Receiver will continue to provide relevant important information on the Cheyenne Mountain website.

  • Hopefully Fresh Start Studios won't repeat the same mistakes, or hire swindlers.

    Battlefield 1943 To Be Patched, PC Version Still In The Works

    While reaffirming that the PC port of Battlefield 1943 is still in the works, Gordon Van Dyke revealed that the console editions will receive a patch sometime soon, though there are no plans for additional content or DLC:

    Speaking with DICE producer Gordon Van Dyke at PAX East, we asked if he could finally end the hopes and dreams that its successful downloadable experiment would receive more content. He informed us, "There's no plans. There's no plans for DLC." However, the PC version is still planned, and there is a patch incoming to address console issues, including mic problems on PS3.

    When asked to elaborate if other classic Battlefield games would receive a reimagined bite-sized release he said, "I can't. There's no specific plans. The success of [1943] has given it an existence within our lineup, in our thoughts. You could possibly see another type of 1943 in the future. But it doesn't mean it's going to be based on 1942."

    According to tweets from DICE devs in recent months, all resources for Battlefield 1943 PC were transferred to Bad Company 2 to ensure a simultaneous multi-platform launch, and once they've fixed the majority of issues discovered within their new release, work will recommence on 1943.

    Natural Selection 2 Playable Engine Test Commences April 9th

    A playable Natural Selection 2 pre-pre-alpha will soon be released, primarily to iron out any kinks in Unknown Worlds' custom-built engine:

    This week we wanted to post an update on the status of the wide scale release of our engine test. If you missed the initial announcement on the mailing list, the engine test is a runnable version of the engine designed to help us tune the performance, compatibility, and networking prior to the release of the Natural Selection 2 alpha. In addition to helping us smooth out any problems, anyone that's downloaded the Spark Level Editor can see their creations in game, and aspiring mod makers can experiment with the included Lua code.

    After the announcement of the engine test a month ago, we started testing with a small group of people outside the company, and (not unexpectedly) we discovered some critical issues that needed to be addressed. For the past month we've been working on improving network reliability, optimizing the Lua interface and tightening up the graphics. Now that these problems are almost resolved, we're planning on releasing the engine test to everyone that's pre-ordered (either edition) on April 9th.

    Since this is a test, we expect there will be some more bumps in the road, but we know you're all excited to start exploring the world of Natural Selection 2, and we're excited to share it with you!

    Journalists vs. Developers, Stop The Hate

    The Escapist has an article up out of PAX East called Why Journalists And Developers Hate Each Other. An early PAX panel got the two groups together to slug it out. Both need each other, so why can't everyone just get along?

    According to the article, from a developer's point of view, journalists are assholes. Some reviewers try to make a name for themselves by trashing a game. Many reviews are factually incorrect, and many journalists do not have the qualifications. Many developers would rather see a lower score combined with a well-written knowledgeable article, than a perfect score with an article that has had no effort put into it.

    From the journalist's point of view, it's a challenge to deal with developers, whom are often unreasonable. It can also be difficult to work with a developer that has a lack of respect for reviewers. Face it, a lot of developers have God-syndrome and reviewers are just the scum on the bottom of their shoes. Some seem to enjoy danging the carrot in front of our faces and watching us perform tricks.

    One thing everyone agreed on was that "Metacritic scores can go fuck themselves."

    *Phew* good thing I'm more of a "News Monkey" than a journalist, and certainly have never uttered a mean word about any developer (except Cryptic, but they don't count). Love me, love me.

    Brief Story Description

In the second part of the saga, Geralt remains at the center of political events.     Story Features In Detail

  • A truly epic, intense, emotionally charged adventure with non-linear game narration. Three independent plot lines with several alternative events are dependent on the player’s choices and lead to multiple different game endings and several additional plot forks. This time gameplay time will be shorter than The Witcher 1, but more intense and packed with events.
  • A complex, realistic and mature story touching upon subject matter seldom seen in other RPGs, told in a manner that is understandable and attractive to contemporary gamers. We investigate the assassinations of the rulers of the Northern Kingdoms and follow Geralt’s personal theme, in which he’s looking for his own identity.   • Rich, mature dialogue as found in Andrzej Sapkowski’s book series and The Witcher 1, presented in highly filmic cutscenes and dialogues sequences, thanks to a new game engine.
  • New, improved system of flashbacks. Now the reminiscences of Geralt, in which we observe the link between our past choices with current actions, are realistically and smoothly woven into the gameplay.
  • Sex and eroticism will be introduced in a much more realistic, involving and mature way, thanks to which sexual relationships are presented more credibly than in TW1.

  • New system of Mutagens gives players the ability to modify the effects of particular skills. You could, for example, enhance and modify the way your spells work, by multiplying the damage – be it greater amount, or dealing with more enemies at the same time.
  • Advanced crafting mechanics vastly increased the possibilities for players to create their own items: about 200 items - weapon and armour elements – are possible, compared with just 10 swords in TW1.
  • Many elements of armour – jackets, gloves, belts, knee pads, etc. increase variety for the player. There’s ability to upgrade each element separately, offering many combinations of armour, as opposed to just four types of armour available in The Witcher 1.
  • Composit-built weapons, allowing many different types of swords (about 300 vs. 10 in TW1).
  • Random statistics introduce additional variety among similar items.
  • New equipment system, streamlining and making gameplay more flexible, thanks to no limits in the number of carried items, clear division into sections, and an improved sorting system.

    Once a poster-child for Aegia's PhysX PPUs, Hydrophobia has resurfaced from development hell as an episodic Xbox Live Arcade title, albeit without the stunning water simulations once touted:

    Dark Energy Digital, a British developer and publisher of video games specializing in digital delivery, is delighted to announce the upcoming action-adventure blockbuster “Hydrophobia” will be published exclusively on Xbox LIVE Arcade.

    “Hydrophobia” has been developed using Dark Energy Digital’s own “InfiniteWorlds” game creation system, which uses bespoke procedural technology. This allows for a AAA retail quality experience for a tiny fraction of the usual file size, pushing back the boundaries for downloadable games.

    The game will also be the first outing for Dark Energy Digital’s revolutionary “HydroEngine” technology – the first true fluid dynamics engine for games. “HydroEngine” models flowing water in real-time, a true physics simulation with emergent behavior which affects objects and characters in the scene with jaw-dropping authenticity.

    “Hydrophobia” is set in the near future when the world has become massively over-populated, and takes place onboard the “Queen of the World”, a city sized ship which tours the globe and is home to the wealthy elite.     Lost Planet 2 PC Pushed To Fall; Multiplayer Demo Available Next Week

    Capcom's plan to release all versions of their multi-platform titles simultaneously have fallen foul of reality - development never goes to plan and sacrifices have to be made to ensure the timely release of the most profitable versions. In the case of Lost Planet 2, that means the May 11th release of the console versions, with the PC release lagging way behind this Fall:

    Prepare to be blown away by the latest Lost Planet 2 demo coming your way next week on Xbox Live and the PlayStation Network. Grab your weapons or jump into one of the game’s new Vital Suits and prepare for intense 16 player online battles. Featuring the ‘Turbulent Jungle’ map from the online versus mode, the new Lost Planet 2 demo will include full chat support and in-depth result stats so players can establish bragging rights.

    While the demo will be widely available from April 21st, Capcom’s most avid fans in Europe will be able to experience the demo from March 31st via a number of early access codes. Codes will shortly be available from www.lostplanet2game.com and will be allocated on a first come, first served basis. Further codes will be available through local initiatives in UK, France, Spain, Italy, Germany and Australia.

    Players who download and play the demo will be rewarded when they purchase the full retail version of Lost Planet 2 by getting immediate access to the Machine Gun SP which fires three round bursts.

    Capcom is also pleased to confirm that the Xbox 360 and PlayStation 3 versions of Lost Planet 2 will now be hitting stores on Tuesday May 11th, one week earlier than previously announced. A PC version is scheduled for release this autumn.

    Free Napoleon: Total War DLC Released

    The Creative Assembly announces the immediate launch of Imperial Guard, a free piece of Napoleon: Total War DLC that adds six new units and the ability to fight at Waterloo as the British:

    Napoleon had the feeling he had won the war as he advanced towards the Anglo-Dutch army at Waterloo. The Prussians were retreating, pursued by a French corps, and only Wellington remained. French armies would be victorious once again, and the Empire would be reborn in fire. But the history book on the shelf would not be repeating itself…

  • This alternative version includes: Britain as the playable faction.
  • Two of the new unit from the Imperial Guard Pack are included in the battle
  • The French have more troops meaning that the battle is balanced differently

    GameStop Sued Over 'Deceptive' Used Game Sales

    A GameStop customer is suing the chain after he discovered that the used copy of Dragon Age: Origins he bought required a subsequent $15 purchase from BioWare to unlock the bonus downloadable content promised on the box. The customer in question claims that GameStop deliberately failed to mention this in their store, despite the box clearly stating that the DLC was only free with new, first-hand purchases:

    The situation began back in January when plaintiff James Collins purchased a used copy of Dragon Age: Origins from a GameStop store in Hayward, California. Collins paid $54.99 plus tax for the game, $5 less than a brand new copy.

    Collins states he purchased the game in part because of the box cover, which advertised that additional character and quest content could be downloaded for free upon purchasing the game. Collins discovered weeks later, however, he would have to pay an additional $15 to access the downloadable content, ultimately paying $10 more than the cost of a brand new copy with the same content.

    When Collins tried to return the game for a refund, the GameStop manager at the store said he could not because the seven-day return window had passed.

    "GameStop, who makes more than 20% of its revenue and nearly $2 billion from the sale of used video games, is aware of this issue, and continues to fail to alert customers that this content is not available on used games," the suit states. "As a result, GameStop tricks consumers into paying more for a used game than they would if they purchased the same game and content new."

    Collins is seeking restitution, punitive damages for fraud, and numerous other compensatory damages.

    Ubisoft DRM Victims Receiving Compensation

    You bought one of Ubisoft's Cloud Copy Protection titles? Were you unable to play on the weekends because naughty children DDOS'd the servers? Well check your email, because Ubisoft is giving out free stuff to say sorry. Goodies on offer vary between countries and the original purchase, but in general there's a selection between H.A.W.X., EndWar, Shaun White's Snowboarding, the cel-shaded Prince Of Persia, and Heroes Over Europe. The irony being that most, if not all, are DRM-free.

    Folks who only forked out for the basic version of Assassin's Creed II can choose to upgrade to the Gold Edition for free, which would normally cost $10.

    Champions Online Xbox 360 Port Axed

    With Bill Roper moving on to Cryptic's next MMO, Champions Online fans asked that the Xbox 360 port be axed and all remaining resources put into the struggling PC version.

    A few hours later Cryptic boss Jackalope revealed that the request was unnecessary, as the console conversion had already been killed:

    100% of our focus is on making the current PC product the best it can be. There are no current plans for a console version of Champions.

    Xbox 360 USB Memory Stick Storage Announced

    Bypass Microsoft's costly hard drives by utilising USB sticks, once the required software update goes live, April 6th:

    On April 6th, we will be releasing a system update over Xbox LIVE for your Xbox 360 that will allow USB flash drives to be used for storing profiles, game saves, demos and more. I’ve been testing this feature out for a few weeks, and I have to say it’s really great. Once you take the system update on April 6th, you’ll be able to connect your USB flash drives to your console and head over to the memory section to configure your new storage device. Once you do that, the system will conduct a one time performance and integrity check to confirm the drive is working properly. You will then be able to configure how much storage to use on the device, up to 16 GB. The remaining space on the flash drive will be accessible by your PC or Mac. USB Hard drives may work, but like flash memory, you’ll only be able to use up to 16GB of space. Since performance on flash based USB storage is usually better, I highly recommend using flash based instead of spinning media like a hard drive…it’s just going to give you a MUCH better experience.

    We’ve also enhanced the memory management functions, so you’ll be able to have better control on what you want to copy or move between storage devices.

    A couple of points:

  • You can have 2 devices connected to the console at a time, enabling up to 32GB of simultaneous storage.
  • The system won’t just configure the device once it is connected to the console. You’ll need to head to the memory area in system settings, select your USB Device, and choose from Configure Now (Format and Configure the Full Device), or Customize (you can choose how much memory you want configured for Xbox360 from the free space on the device.)

    While any flash drive can be used, we are partnering with SanDisk to release an Xbox 360 branded USB flash drive in May that comes pre-configured out of the box and ready to go. I’ll provide links to those drives once they’re available. Until then, starting April 6th (when we release the system update) you can pop any flash drive over 1GB into your Xbox 360 and configure it as storage.

  • I look forward to the inevitable revelation from hardware hackers, detailing how the 16GB is some sort of artificial limit imposed by Microsoft.

    Dr. Breen Is Dead

    While I was out for the count with my brain-splitting migraine, the actor who played Dr. Breen in Half-Life 2 fell and hit his head. Being old, the fall proved fatal. Of course, Robert Culp did more than Breen during his 79 years, perhaps being best known outside of gaming for I Spy, a groundbreaking show starring Bill Cosby.

    When Mythic announced its new "endless trial" scheme for Warhammer Online yesterday, I was confused. I knew they already had an endless trial, assuming that one wants to play Tier 1 endlessly. So when Andrew poked me (because he doesn't feel it's macho for him to post MMO news ;) I punched him in the eye and kicked him in the balls for doubting my MMO authoritah in the matter.

    Then he explained that it's not just an endless trial, if you want to subscribe to Warhammer Online you just subscribe, you no longer need to purchase the actual game. Yup, yup, Warhammer Online is now free to download. Just pay your sub or use the endless trial. And that is the story of why Andrew has raw meat on his eye and a frozen bag of peas on his groin today.
